1. About this Disclaimer
This Disclaimer applies to the GetNuans website and to every NUANS® reservation report and preliminary name search ordered through it. It is incorporated by reference into our Terms of Service; if there is any conflict between this Disclaimer and the Terms of Service, the Terms of Service govern.
By accessing the website or placing an order, you acknowledge that you have read, understood, and agree to this Disclaimer. If you do not agree with any part of it, please do not use the website or our services.
2. Independent private service — not a government agency
GetNuans is an independent private service operated by a NUANS member. It is not affiliated with, endorsed by, or operated by the Government of Canada, the Government of Ontario, or the Government of Alberta.
Reports are obtained using a NUANS® member's authorized access to the NUANS® system. The fees we charge are private service fees for preparing, obtaining, and delivering your report or search result; they are not government filing fees, and ordering from this website is not a government filing.
3. Not legal or professional advice
GetNuans is not a law firm, and no employee or representative of GetNuans acts as your lawyer, accountant, or professional advisor. All information on this website — including product descriptions, guides, blog posts, FAQ answers, and support responses — is general information provided for educational purposes only. It is not legal, accounting, tax, or filing advice, and no lawyer-client, accountant-client, or other professional relationship is created by your use of the website or our services.
Before choosing a corporate name, incorporating, or making any other business decision, we strongly recommend that you consult a qualified lawyer for legal matters, a certified accountant for financial and tax implications, and other relevant professionals for your specific situation. If you act on information from this website without professional advice, you do so at your own risk and assume sole responsibility for the outcome.
4. Nature and limits of a NUANS® report
A NUANS® report is a name-search document. It identifies existing corporate names, business names, and trademarks in the NUANS® system that may be identical or confusingly similar to your proposed name, for the jurisdiction you select.
A NUANS® report does not itself approve, register, incorporate, or trademark a proposed name.
A report reflects only the data available in the NUANS® system at the time the search is performed and the exact name details you provide. It may not capture every similar or conflicting name — including names in registries or databases not covered by the NUANS® system, unregistered trade names, and common-law trademark rights — and results can change over time as new names are registered. A report is generally valid for ninety (90) days from the date of the search.
A preliminary name search is a screening tool only. It is not a NUANS® report, cannot be submitted with a filing, and provides no assurance that a subsequent NUANS® report or filing will produce a favourable result.
5. No warranties or guarantees
The website, our services, and all reports and search results are provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in the Terms of Service and subject to rights that cannot be excluded under applicable law.
We cannot and do not guarantee: that any proposed name will be approved, accepted, reserved, or available; that any registry will accept a filing supported by a report; the processing timelines of any government registry; that a report is free of omissions or captures every similar name; that using a name identified as available will not infringe the rights of others; or that the website will operate uninterrupted and error-free. Name acceptance is decided solely by the applicable government registry, based on factors outside our control.
6. Information accuracy and currency
While we make reasonable efforts to keep the content of this website accurate and current, it may contain typographical errors, inaccuracies, or omissions. Laws, registry rules, government requirements, and fees change from time to time, and information on this website may not reflect the most recent developments. You are responsible for verifying current requirements with the applicable registry or a qualified professional before relying on them.
We reserve the right to modify, update, or remove website content at any time without notice, and we assume no obligation to update any information.
7. Your responsibilities and acknowledgments
By using the website and our services, you acknowledge and agree that: you are responsible for providing accurate and complete order information, including the exact spelling of your proposed name and the correct jurisdiction; you understand what a NUANS® report and a preliminary search do and do not provide; you are responsible for reviewing your report and deciding, with professional advice where appropriate, whether to proceed with any filing; you remain responsible for your own business decisions and compliance obligations; and you use the website and our services at your own risk.
8. Third-party systems and links
Our services rely on third-party systems — including the NUANS® system, our payment processor, and email delivery providers — and we are not responsible for their content, accuracy, availability, or practices, nor for omissions or inaccuracies in third-party or government databases reflected in a report or search result.
Links to third-party websites are provided for convenience only. We do not endorse, control, or monitor them and accept no responsibility for their content, privacy practices, or any transactions you enter into with third parties.
9. Jurisdictional limitations
Our reports and searches relate to Canadian jurisdictions only, and the information on this website is intended for use in connection with Canadian filings. It may not be applicable outside Canada. International users are responsible for verifying applicability and complying with the laws of their own jurisdiction, and should seek appropriate local professional advice.
10. Limitation of liability
To the maximum extent permitted by applicable law, including the Consumer Protection Act, 2002 (Ontario), GetNuans shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of this website or our services, including loss of business profits, revenue, data, or use, and our total liability for any claim shall not exceed the amount you paid for the order giving rise to the claim.
The full limitation of liability, including its exceptions for liability that cannot be excluded by law, is set out in the Terms of Service and applies to this Disclaimer.
11. Relationship to our other policies

For the complete terms governing ordering, payment, delivery, refunds, and data handling, please review our Terms of Service, Refund & Return Policy, and Privacy Policy, each of which is available on this website.
