Privacy Policy

This Privacy Policy explains how GetNuans collects, uses, discloses, retains, and protects your personal information when you visit our website or order a NUANS® reservation report or preliminary name search, and the rights and choices you have. It is incorporated by reference into our Terms of Service.

Effective date: July 9, 2026. This version supersedes all prior versions of this Policy.

1. Introduction

GetNuans (“we”, “us”, or “our”) is committed to protecting your privacy in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws. This Privacy Policy applies to personal information collected through our website and in the course of providing NUANS® reservation reports and preliminary name searches.

By accessing the website or placing an order, you consent to the collection, use, and disclosure of your personal information as described in this Policy. If you do not agree with this Policy, please do not use the website or our services.

2. Accountability and privacy contact

We are responsible for personal information under our control and have designated a privacy contact who is accountable for our compliance with PIPEDA and this Policy. Privacy inquiries, requests, and complaints can be directed to [email protected] or submitted through the Support page, marked to the attention of the privacy contact.

3. Personal information we collect

Order information: the proposed corporate name, main business activity, distinctive element, alternate spellings, filing jurisdiction, and search purpose you provide when placing an order.

Contact information: your name, email address, and phone number where provided, along with any messages you send us through the Support page or by email.

Payment information: card payments are handled by Stripe, our payment processor. We receive confirmation of payment and limited transaction details such as the payment status and the last digits of your card, but we do not receive or store your full card number.

Technical information: standard server logs such as IP address, browser type, device information, pages visited, and access times, used to operate, analyze, and secure the website.

We collect only the information reasonably necessary to provide our services. We do not request or collect government-issued identification numbers, dates of birth, or banking details.

4. How we collect personal information

Directly from you: through the order forms, checkout, the Track Order page, the Support page, and email or other correspondence with us.

Automatically: through server logs and cookies or similar technologies when you browse the website, as described in Section 11.

From third parties: payment confirmations and fraud signals from Stripe, delivery status from our email delivery provider, and search results returned by the NUANS® system in response to the details you submit.

5. How we use personal information

We use your information to: process, confirm, and fulfil orders; generate and deliver your NUANS® report or preliminary search result; provide order tracking and customer support; send transactional communications such as receipts, confirmations, and delivery emails; maintain order and accounting records; detect and prevent fraud, abuse, and unauthorized access; comply with legal, tax, and regulatory obligations; and operate, secure, and improve the website and our services.

We do not sell, rent, or trade your personal information, and we do not use it for third-party marketing.

7. When we share information

We share personal information only as needed to operate the service, with: Stripe, to process payments and prevent fraud; our email delivery provider, to send receipts, notifications, and reports; the NUANS® system, to run the search you ordered; and hosting and technology providers that store or process data on our behalf under appropriate safeguards.

We may also disclose information: where required or authorized by law, including in response to a court order, subpoena, or lawful request by authorities; to detect or prevent fraud or to protect our rights, property, or safety or those of others; to enforce our Terms of Service; and in connection with a business transaction such as a merger, acquisition, financing, or sale of assets, to a successor or assign bound by appropriate privacy protections.

8. Data retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy and to meet legal requirements. As a general guide: order records, invoices, and transaction records are retained for up to seven (7) years to satisfy tax and accounting requirements under Canadian law; generated reports and search results are retained so we can re-send them and support you after an order, and remain retrievable through the Track Order page for a limited period; and support correspondence is retained for as long as needed to resolve the matter and maintain a service history.

When personal information is no longer required, it is securely deleted or anonymized. Anonymized data that no longer identifies you may be retained for analytics and service improvement.

9. Your privacy rights

Under PIPEDA and applicable Canadian privacy laws, you have the right to: request access to the personal information we hold about you and information about how it has been used and disclosed; request correction of inaccurate or incomplete information; withdraw consent as described in Section 6; and file a complaint about our privacy practices.

To exercise any of these rights, contact [email protected] with your order number where applicable. We may need to verify your identity before acting on a request. We respond to access requests and privacy inquiries within thirty (30) days as required by PIPEDA; if we refuse a request in whole or in part, we will explain why and the recourse available to you.

10. Data security

We protect personal information with safeguards appropriate to its sensitivity, including: encryption in transit (TLS/SSL) for all data exchanged with the website; access controls limiting personal information to those who need it to provide the service; reliance on established, security-audited providers such as Stripe for payment processing, so that full card details never touch our systems; and monitoring and logging to detect unauthorized access.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we work continuously to protect your information and to limit access to it.

11. Cookies and tracking technologies

The website uses cookies and similar technologies that are necessary for it to function — for example, to maintain your session while you place an order. We may also use limited analytics to understand how the website is used and to improve it.

You can control or delete cookies through your browser settings. Disabling essential cookies may prevent parts of the website, including checkout, from working properly. We do not use cookies for third-party advertising, and we do not respond to browser “do not track” signals beyond the practices described in this Policy.

12. Electronic communications

By placing an order or contacting us, you consent to receive electronic communications from us relating to your order and our services, including confirmations, receipts, delivery emails, and support responses. These transactional communications are a necessary part of the service and cannot be opted out of while an order is active. We do not send marketing messages without your consent, and any optional communications will include a way to unsubscribe, in accordance with Canada's Anti-Spam Legislation (CASL).

13. International transfers

We operate from Canada, but some of our service providers — including our payment processor, email delivery provider, and hosting providers — may store or process information outside Canada, including in the United States. While information is in another jurisdiction, it is subject to the laws of that jurisdiction and may be accessible to its courts and authorities under lawful process. We use contractual and other safeguards to require that service providers protect personal information to a standard comparable to this Policy, and we limit transfers to what is necessary to deliver the service.

14. Privacy of minors

Our services are intended for users who have reached the age of majority in their province or territory of residence, and in any event are not directed to persons under eighteen (18) years of age. We do not knowingly collect personal information from minors; if we learn that we have done so, we will delete it.

15. Business names and public registry information

The proposed business name and related search details you submit are used to run a search against the NUANS® system, which contains existing corporate names, business names, and trademarks drawn from public registries. Information about businesses — such as registered business names and registered addresses — that appears in public registries is generally not personal information under PIPEDA. If you subsequently file your proposed name with a registry, the information you file may become part of the public record; such filings are made by you, not by GetNuans.

16. Breach notification

If a breach of security safeguards involving personal information occurs, we will assess it and take immediate containment and remediation measures. Where the breach creates a real risk of significant harm, we will notify affected individuals and report the breach to the Office of the Privacy Commissioner of Canada as required by PIPEDA, and we will keep records of all breaches as the law requires.

17. Updates to this Privacy Policy

We may update this Policy from time to time to reflect changes in our practices, technology, or legal requirements. The effective date at the top of this page shows when the current version took effect. Material changes will be posted on this page, and your continued use of the website or our services after a change is posted constitutes acceptance of the updated Policy.
